Thanks to a change in case law recently made by the 4th Circuit, it is now possible to partially strip off a second mortgage lien from your property in a Chapter 13 case. That means that upon completion of your Chapter 13 case, you will be able to achieve a cancellation of a part of your second mortgage balance if your house is underwater.



If you were previously a debtor in a Chapter 7 case in Virginia more than 8 years ago, and you need to file another Chapter 7 petition, beginning July 1, 2020, you will be able to recapture any homestead exemption to protect your belongings that you used up in your old case, and apply it in your new case.
